David D'Amato writes: As the legal melee between Apple and Samsung continues, the “patent wars” are again front-page news. During August of this year, the International Trade Commission, successor to the Progressive Era-founded Tariff Commission, announced that Samsung can no longer import into the U.S. certain mobile devices. The Commission found that the subject products infringe on a number of Apple’s patents, but the president may still veto its decision regarding importation. As it happens, when the reverse scenario came about in June, and the Commission banned Apple from importing products infringing on Samsung patents, Obama did wield his veto. The legal and political drama at hand is just the latest installment in an ongoing string of lawsuits aimed at protecting, in the words of The New Yorker’s Nicholas Thompson, “patents that are often either inscrutable or mundane.”

Nokia Deal Could Mark the Last Chapter for Microsoft / Companies / Microsoft

As a value investor I used to spend a great deal of time in Microsoft hell – on one hand there was the company with enormous cash flows, an incredible return on capital, a huge moat, a cash-rich balance sheet, and trading at single-digit multiples (if you adjust for cash).  But on the other hand it threw away cash away for multi-billion-dollar acquisitions, followed up by inevitable write-offs.  Its founder and chairman was not interested in running the company, so he delegated to his best friend, who has been wrong at every single technological inflection point, and quite frankly not a very good leader.  Every few years the company airbrushes its old products (think of Office), calls it an upgrade, and goes on charging subscription fees; but new products quite frankly … suck.  Microsoft's competitors are getting better, and while a strong balance sheet helps in bad times, it is not a competitive advantage against competitors that have even more cash.

As if the federal government were not already doing enough to kill the U.S. airline industry with restrictive workplace rules, over-regulation, and a monetary policy that supports higher fuel prices, earlier this month anti-trust authorities at the Justice Department blocked the merger between American Airlines and US Air. (Unbelievably, the regulatory roadblock was thrown up more than a year after the two companies had agreed to terms, and after great expense has been incurred to integrate operations). Although long suffering investors had hoped that the merger would allow the beleaguered airline to finally exit bankruptcy, in the days after the surprise announcement, AMR stock almost fell as much as 60%.
